If there was any doubt about the complete incompetence of Attorney General Eric Holder, it was forcefully put to rest today during a spectacular shellacking by Senator Lindsey Graham (see realclearpolitics.com for the video clip). Holder actually appears to realize, for the first time in the middle of questioning by Graham, that KSM will be the first enemy combatant to be tried in a civilian court. C'mon, for an ivy league educated lawyer, this precedent should have been totally obvious and more importantly, the implications that come with it (like what happens if KSM gets acquitted). At what point did Holder think the chances for conviction were better in a civilian court when KSM has already asked to plead guilty in front of a military tribunal?
The real issue of course is what this episode says about Holder and his total lack of judgment. My prediction is that the course of action he is proposing, if allowed to proceed, will ultimately cost him his job. Exit question: should Holder either resign or get bounced by Obama, could his replacement be worse still?
